FOREWORD

The International Poster and Graphic Design Festival of Chaumont came into life from a collection of vintage posters, which Gustave Dutailly had passed on to the town. The zeal, with which this man collected images of his time, discerned their quality, is behind this French cultural collection that concerns graphic designers as much as the inhabitants of Chaumont. For 21 years now, the Festival has accompanied poster-making and its development by organizing each year an international poster competition further supported by ICOGRADA.

This meeting place with the profession is a rare opportunity to follow up on and confront the contemporary development, to plot - year after year - the scenes for its quality and value. 100 to 120 selected posters will be exhibited during the Festival, the highlight of which every year is the awards ceremony. By inviting you to send us up to five posters made since 2007, we also invite you to come and attend the Festival on coming May 29 and 30.

Once the awards and exhibitions are over, the selected posters become part of the collection of contemporary posters built up over 21 years of Festival. This association between the contemporary collection and the Dutailly collection is the foundation of the project of an International Graphic Design Centre (CIG). Graphic design in Chaumont is already focusing on the CIG before its construction and for the first time, the International Competition will allow to build-up a selection of French posters intended to spot the high places for graphic design in France and to encourage commissions of value, by means of carrying through exhibitions and mediation following the Festival.

International Poster Competition and Selection of the best French Posters.

For the first time, the International Poster and Graphic Design Festival of Chaumont is organizing a selection of the best French posters concurrently with the International Competition. Posters or series of posters, meeting following criteria can compete for this national selection.

It must :
• be French by its author, client or printer,
• have been produced during the season 2008-2009,
• be submitted to the International Competition and meet the demands of its rules.

This selection will be made over and above the selection and the awards of the International Competition.

The distinction of the selected posters (10 to 15 posters without ranking among them) rewards jointly the author, the client and the printer.

A travelling exhibition of the selected posters will be organized in order to promote graphic design, the significance of commissions as well as exemplary graphic communication.

For the 21st Chaumont International Poster and Graphic Design Festival of Chaumont, the electronic registration on the site prior to any shipment is required.

You must read and accept the rules of the competition, the letter of agreement, the gift by hand form and its appendices in their electronic form. A PDF version should be printed and, signed on each page and returned with your original printed works.

The form gathering the details about the Artist and sent work(s) must be printed and sent with its appendices, posters and registration documents.

A CD or a DVD is also to be sent by postal mail with a non-compressed TIFF file, to 88 cm x 60 cm, in 300 dpi, CMJN or RVB of a max size 130 Mo of each registered poster.

REGULATIONS

INTRODUCTION

In the context of the 21st International Poster and Graphic Design Festival of Chaumont, which will take place from May 29th to June 20th 2010, the International Poster Competition is launched, open to any printed poster created since January 1st 2007, whether they be cultural, social, political or commercial. They can either be issued by private commissioners or public organizations.
The Competition and the Festival aim at reviewing the worldwide production of these past three years and are intended for graphic designers as well as studios, but also for all the institutions or companies concerned. The posters can be the work of one sole artist or of a group. Graphic designers from all over the world are invited to participate in this event.
The selected posters will be exhibited during the Festival and prizes will be awarded.

NOTA BENE : If you have already taken part in previous Competitions in Chaumont, please make sure you enter different posters created within the past three years.

Exhibition

On April 19th and 20th 2010, a pre-selection Jury made up of French and international graphic designers will determine the selection of received posters according to the competition’s rules to constitute the international exhibition. All the selected posters will be exhibited from Saturday, May 29th to Sunday, June 20th 2010 during the 21st International Poster and Graphic Design Festival of Chaumont.

Prizes and Certificates

The international jury, mainly composed of internationally renowned graphic designers representative of at least four continents, the list of whom will be available at the beginning of March 2010, will make its final selection among the preselected posters. The international Jury will meet on Friday, May 28th and Saturday, May 29th and the award winners will be announced in the late afternoon, on Saturday, May 29th 2010. It will award the prizes for a work or a series of works presented as such.

First Prize : 7500 €

Second Prize : 4500 €

Third Prize : 3000 €

The international Jury may further award a special prize, if it is considered appropriate. This award will be a certificate. The jury will also attribute an « Excellence Award » ICOGRADA.

Registration terms and conditions

The competition shall be carried out in accordance with the rules and recommendations of the ICOGRADA (International Council of Graphic Design Association). Any person taking part in the International Competition of the 21st International Poster and Graphic Arts Festival of Chaumont implicitly agrees with its regulations. The artists can present from 1 to 5 posters, provided they have been created after January 1, 2007.
The posters must imperatively be made on paper, no matter what printing method is used, and be realised following an actual commission.

The artists, whose posters are shortlisted, agree to provide a second copy for exhibition purposes. The artists can present their posters as individual works or as part of a series (please mention it clearly on the registration form). The organizers reserve the right to reject the posters offending morality, or religious or national beliefs, as well as any and all posters breaching the regulation.

The artist also declares that he/she has read and accepted the terms of the transfer and exploitation pertaining to the works received in compliance with the terms of the agreement letter in the appendix 1 of these regulations.

All the posters received for the International Competition become a gift to the Town of Chaumont for their conservation at the Silos/Maison du Livre et de l’Affiche (appendix 2).

We wish to draw your attention to the fact that this letter of agreement was drawn up by the Town of Chaumont in consultation with the Ministry of Culture, the DRAC Champagne-Ardenne, the Alliance Graphique Internationale, the Alliance Française des Designers, and the Syndicat National des Artistes Plasticiens CGT.

If the appendices are not returned signed by the artist, his/her entry cannot be taken into account.

The shipping charges of the posters, as well as the custom duties are chargeable to the sender. The organizers reserve the right to refuse any posters sent in with a custom payment due.

To avoid customs fees, state mandatory on shipments, "printed, with no commercial value.".

Each poster entered must bear the following information on the back side :

- The name of the artist,

- The number of the poster in the top left hand corner,

- If applicable, the title of the poster in French or in English.

The registration form data on the website must be printed. It lists the posters matched with their numbers and data.

This sheet must be signed by the artist or his/her representative.

The form must neither be glued nor taped on the back of the poster. The size of the poster must be indicated in centimeters (height x width). An incomplete entry form will be considered grounds for exclusion from the competition. The posters should not be framed or mounted on cardboard. They should be carefully protected for shipping, which is at the entrant’s charge. The organizers decline any responsibility in case of loss or damage of the posters in transit.

If the poster is a collaborative effort of several artists, the names of individual artists must appear on the registration form.




LETTER OF AGREEMENT

Between the Town of Chaumont, represented by the Mayor in office,

And Mr. or Ms. First Name and Surname of the graphic designer, author of the posters, hereafter referred to as the author,

Twenty years ago, Chaumont revived its links with the nineteenth century's poster artists through the Dutailly collection, a bequest made in 1905 of works by the most talented artists from a period when poster-making reached extraordinary heights as an art form. This gave rise to the Chaumont International Poster Festival, a bridge between the nineteenth century and contemporary graphic design.

From that time on, the Town has endeavoured to promote and develop this extraordinary collection through :

- the creation, in 1994, of Les Silos - Maison du Livre et de l'Affiche, a 5,000 sq m space which includes a multimedia library, graphics centre, screen-printing workshop, the reserve collections of contemporary and vintage posters, and an exhibition space.


- the organization of the annual International Poster and Graphic Design Festival, launched in 1990.


As part of the International Poster and Graphic Design Festival, the Town of Chaumont has, since 1990, been entrusted with original posters resulting from commissions.
More than 30,000 contemporary works have thus been added to Chaumont's original collection of the 5,000 posters in the Dutailly bequest.
These works are kept in a municipal facility: Les Silos - Maison du Livre et de l'Affiche.
They are professionally digitized, indexed and stored. The Town's work is acknowledged by its partners, in particular the Bibliothèque Nationale de France which has made Chaumont an associated resource.

In return for this invaluable contribution from talented graphic designers all over the world, the Town of Chaumont undertakes to continue its support of international graphic design through its role as a place where today's graphic designers can exchange, where works can be viewed, and where students and recognized graphic designers can meet, and as a place of research as the field of graphic design continues to evolve.

Towns and regions have reviewed their planning, cultural, social and economic projects to incorporate wide-ranging cultural centres. The creation in Chaumont of the Centre International du Graphisme (International Centre of Graphic Design), a foremost establishment promoting culture across society, is intended to serve a dynamic regional process that will drive urban development.

In this context, as a provider of public services, the Town of Chaumont will ensure that copyright is protected during any use of the works which are entrusted to it and which require such protection, thereby contributing to the continued production of artworks.

As a participant in the International Poster Festival competitions in previous years, you have entrusted one or more of your works to the Town for use as part of initiatives to diffuse culture, engage new audiences and promote graphic design, within the strict framework of the Town's public service functions.

As part of the development of these public interest activities, and with the aim of promoting graphic design and its poster collections, the Town of Chaumont wishes to reproduce and show these posters at exhibitions organized at Les Silos and outside venues. The Town also wishes to publish catalogues for each festival and to promote exhibitions which are organized at its initiative and under its control. Lastly, in partnership with the Bibliothèque Nationale de France, the DRAC Champagne-Ardenne (Regional Department of Cultural Affairs) and the Champagne-Ardenne Region, it wishes to create a database of all the posters to have been entered in Chaumont's Poster Festival, and the vintage posters bequeathed to the Town.

We have received, on these various accounts and with your agreement, the following posters, hereafter referred to as the Creations :

We wish to draw your attention to the fact that this letter of agreement was drawn up by the Town of Chaumont in consultation with the Ministry of Culture, the DRAC Champagne-Ardenne, the Alliance Graphique Internationale, the Alliance Française des Designers, and the Syndicat National des Artistes Plasticiens CGT.

The Town of Chaumont wishes to obtain from you the authorisations listed below :

These authorisations are strictly limited to the uses that the Town of Chaumont may initiate in the context of its public service functions, i.e. for cultural or educational purposes and to promote graphic design.

These authorisations are granted to the Town of Chaumont on a non-exclusive basis. Consequently, you remain free to use your Creations in any form and using any media.

Article 1. Physical ownership of the Creations

You have provided xx copies of your Creations in paper / digital format, notably for your participation in the International Poster Festival.

Where appropriate, you confirm that you have given these formats to the Town for inclusion in the collections. A document confirming a gift by hand to the Town is duly annexed to this letter of agreement.

Article 2. Intellectual property

2.1 Moral rights

2.1.1 It is noted that all your moral rights are preserved and that you may exercise them in accordance with the terms of articles L.121-1 and following of the French Intellectual Property Code.


2.1.2 Your name or pseudonym as the author will be mentioned on all forms of reproduction of the Creations.


2.1.3 Given that some exhibitions may take place outside or at non-specialised venues (schools, colleges etc.), the Creations may be duplicated so as to preserve their integrity and avoid deterioration or weather-related damage. The Town believes that the integrity of the original work must be respected and consequently will endeavour to produce a duplication that respects the work's technical and artistic qualities.


2.1.4 In order to respect your name and quality as the author, you expressly authorize us to reproduce, at no charge, your biographical notice and portrait with the relevant format in printing and on the Internet throughout the period of use of the Creations.

2.2 Proprietary rights

We draw your attention to the fact that you retain the right to use the Creations in any way that is not expressly mentioned within the context of this letter of agreement.

2.2.1 Public communication

2.2.1.1 You expressly grant the Town of Chaumont non-exclusive authorization to reproduce the Creations and show them to the public as part of exhibitions.

This authorization concerns exhibitions with the following characteristics :

- Organization : group exhibitions staged at the initiative and under the control of the Town as part of its public service functions,

- Location :

• the Town of Chaumont, or,

• teaching and research establishments (schools, training centres, multimedia libraries, etc.), or,

• Cultural centres, or,

• Exhibition spaces in administrative buildings such as Town Halls, Prefectures, Regional Councils etc.

- Maximum duration of each exhibition : three months ;

- Admission : free for the general public.


2.2.1.2 You will be advised by email or at the postal address given in article 6 of this agreement, and via a website, of the group exhibitions that the Town wishes to organize including one or more of the Creations mentioned in this agreement.

A group exhibition is understood to mean any exhibition that includes the work of various artists on a common theme. Failure to respond to this notification within thirty days of its being sent will constitute approval of the project.


2.2.1.3 With respect to public showing rights, you authorize the Town, at no charge, to include the works in exhibitions mentioned in this article and organized under the management and control of the Town, either alone or in partnership with other local or regional authorities or French public establishments in their role as public service providers.

If a personal retrospective of your work should be planned, you will be informed of this and a specific agreement will be concluded with you.

2.2.2 Authorization of reproduction

a) Free publicity material

The exhibitions mentioned in article 2.2.1.1 may be accompanied by publicity material that will be made available to the public free of charge (small posters, programmes, brochures, press releases, etc.). You also authorize the Town to reproduce your Creations at no charge in this free publicity material.

It is noted that article L.122-5–9 of the French Intellectual Property Code has introduced an exception for news items. As a result, you cannot prohibit the reproduction, or full or partial representation of your Creations in written, audiovisual or online news reporting with the sole purpose of providing information and in direct relation with the exhibitions organized.

b) Exhibition catalogues

You also authorize the Town to publish, co-publish, print or have printed in all languages the catalogues for the exhibitions organized at its initiative and under its control.

These catalogues may be offered free of charge or sold through any book distribution network.

In return for the publication of group exhibition catalogues, the Town will pay you a net fixed fee in the form of royalties in compliance with the provisions of article L.131-4-4 of the French Intellectual Property Code.

This fee shall be fixed at 50 euros inclusive of taxes per Creation included in the catalogue.

This fee has been determined on the basis of the Town's current publications, i.e. catalogues sold at a retail price of approximately 35 euros, of which some 2,500 copies are sold.

You will also receive, in recognition of your contribution, a free copy of the catalogue for your personal use.

In the event of substantial change to these publication characteristics, the fee paid will be determined in good faith by mutual agreement between the parties.

Any other planned publication (catalogue raisonné, monograph, special edition, etc.) will give rise to a special agreement, mutually negotiated between the parties.

c) Authorization to digitize, reproduce and publicly show the Creations in the context of a database that can be accessed via the Internet and any other media (including CD-ROMs and DVDs) and analogue or digital networks :

As part of this authorization, you grant the Town the right to organize and compile a digital database of the Creations. This database will be available to the public, at no charge, via a website for the Town's archives.

This website will take the necessary technical measures to protect your creations by :

- using protected files with a maximum resolution of 600 x 600 pixels (keeping the proportions of the original image) ;

- always giving your name or pseudonym as author of the creations. The date and place of creation of the work will be indicated if the author provided the appropriate information when submitting the work ; and

- including a notice prohibiting the reproduction, representation and/or public showing of your work, without your authorization, by any natural person or legal entity, and the legal penalties that such action will incur.

This database may give rise to the production of themed CD ROMs or DVDs. These will be used exclusively for educational purposes, to engage new audiences or for research.

Insofar as the database will be freely accessible via the Internet, authorization is granted to the Town of Chaumont for all territories in the world and for all languages.

You authorize the Town, at no charge, to use the Creations to compile the database of archives and to diffuse the Creations online and offline as stated in this article.

2.2.3 Duration and extent of authorization

2.2.3.1 In view of the Town's archive project, this authorization is granted for all countries and all languages.

2.2.3.2 This contract is agreed for a period of five years.

At the end of this period, it will be automatically renewed for periods of five years, unless notice of termination is given by registered letter with acknowledgement of receipt at least six months before the renewal date.

If this contract is not terminated during your lifetime, it will be renewed for the legal period for literary and artistic copyright according to current and future legislation in France and other countries and international conventions, including possible extensions that may be made to this period.

Article 3. Archiving

3.1 Firstly, it should be noted that article L.122-5-8 of the French Intellectual Property Code specifies that an author may not oppose "the reproduction of a work carried out for conservation purposes or with a view to maintaining conditions for its onsite consultation by public libraries, museums or archive departments, provided that the latter do not seek any commercial or economic benefit.".

Creations may therefore be photographed or digitized for conservation purposes.

3.2 Given the importance of the archives, were a third party to contact the Town with a request for one or several posters in a physical or digital format, it is understood that :

- The Town will send the author's or their beneficiaries' contact details to the third party ;

- The Town will provide the third party with a copy of the work in a publishable format on presentation of proof that the author or their beneficiaries have given their written authorisation.

Article 4. Transfer

The Chaumont International Poster and Graphic Design Festival is organized every year in partnership with the Festival Association. This authorization can also apply to the Festival Association. Furthermore, if, in the future, a structure under public law were created specifically for the Centre International du Graphisme, this authorization may be transferred with all its responsibilities and benefits to this public legal entity.

Article 5. Guarantees

You expressly guarantee the Town of Chaumont that you are the author of the Creations and the only person authorized to enter into this letter of agreement. You will thus hold the Town of Chaumont harmless against any appeal or action that may be brought by any natural person or legal entity on any basis, and in particular any bodies or companies concerned with the management of copyrights and related rights, which may consider that they have a claim of any sort relating to the authorizations granted in this agreement or any one of its provisions.

The Town of Chaumont has set itself the task of contributing to the conservation of the 5,000 posters of the Dutailly bequest and of the 27,000 posters submitted by graphic designers as part of the International Poster Festivals, and to study, add to, present to the public and promote the collections for which it is responsible and which are in its possession.

The Town wishes to promote and develop this extraordinary heritage.
